In California:
Paid in circumstances when a parent doesn't live with the child and other adult. Typically, awarded in divorce cases and, typicallly, lasts until the child is 18 or 19 and unmarried and in high school.
Federal Consumer Credit Protection Act
--50% of disposable income if there is a 2nd family
--60% if there is no 2nd family
*Disposable income is after-tax income.
If you have $100,000 in disposable income $50,000 goes towards child support! This is ridiculous! The wage earner parent then has $50,000, or less, to live off fully while the child also gets the same amount with housing paid for by the other parent plus the other parent's income.
There is no protection for the parent paying child support from homelessness. What if $50,000 a year is all you have to live on and thus is not a livable wage for this parent? They could be left living out of their car living on a small income due to child support!
I think housing costs and utilities should be taken into consideration before child support allotments should be awarded!
And how do you know hen child support is awarded how that money is being used? I think receipts should have to be submitted to the child support paying parent! The child should be benefiting from child support not the ex-spouse.
